Electronic Communications Notice
ELECTRONIC COMMUNICATIONS NOTICE
This Electronic Communications Notice ("Notice") explains how GOT2DEV, INC. ("GOT2DEV," "we," "us," or "our") may provide electronic records, agreements, disclosures, notices, billing information, and other communications relating to Got2Dev Business Manager (the "Service"). This Notice should be read with the published Terms of Service, Privacy Policy, Subscription & Payment Terms, and other applicable policies. It does not replace any separate electronic-consent disclosure, signature requirement, or delivery method required for a particular transaction by applicable law.
1. CONSENT TO ELECTRONIC COMMUNICATIONS
Where we seek consent to electronic delivery, the person affirmatively accepting it agrees to receive the identified categories of records in electronic form for the account, business relationship, or transaction described at the time of acceptance, subject to applicable law. A person accepting on behalf of a Business represents that the person is authorized to do so. Agreement to electronic delivery is not, by itself, authorization for recurring payments, consent to promotional marketing, or acceptance of a separate transaction or customer-facing electronic signature. A record required by law to be provided in writing to a consumer will be delivered electronically in place of paper only when the applicable requirements for valid electronic consent and delivery have been satisfied. We do not treat mere account use or an email address alone as satisfaction of a law that requires affirmative electronic-record consent.
2. SCOPE OF ELECTRONIC DELIVERY
Depending on the applicable account relationship, consent, transaction, and available Service features, electronic delivery may include applicable Terms and policy updates; account-registration and access notices; subscription, billing, renewal, cancellation, and payment communications; receipts; security alerts; service announcements; support communications; and other records associated with a Business or user account. The categories covered by any legally required consent will be identified before that consent is obtained, including whether it applies to a single transaction or an identified ongoing set of records. Delivery obligations and permissions for communications from a Business to its own customers are separate from GOT2DEV's communications about the Service. Nothing in this Notice authorizes unlawful marketing or waives legally required consent or opt-out rights for commercial messages.
3. ELECTRONIC DELIVERY METHODS AND LIMITATIONS
Where appropriate and supported, GOT2DEV may make communications available within the Service, through account notifications, by email to a contact address associated with the account, through viewable or downloadable web pages, or by another disclosed electronic delivery method. Actual methods may vary by communication type and the features enabled for the recipient. Electronic transmission does not guarantee delivery or receipt: messages may be delayed, rejected, filtered, misdirected, or unavailable during outages, and an in-app notice may not be seen until a user signs in. A message is not deemed legally delivered solely because we attempted transmission if applicable law requires a different delivery method, acknowledgment, or proof of receipt. Any legally required timing, format, or method of notice continues to apply.
4. ACCESS, RETENTION, AND HARDWARE/SOFTWARE REQUIREMENTS
To use generally available electronic records, recipients ordinarily need internet access, a compatible browser or device capable of displaying standard web pages, an accessible email account when email delivery applies, and the ability to view, save, or print the relevant records. Some records may require compatible software capable of viewing PDF files or another format expressly identified when that record is made available. Users should retain copies of records important to them rather than assume every item will remain accessible indefinitely through the Service.
Where a law requires particular hardware/software disclosures before consumer consent to electronic records, we will present the specific applicable requirements before obtaining that consent. Where such law requires an electronic demonstration of the recipient's ability to access the record format, the applicable consent process must provide it. If later requirements materially change in a way that creates a legal obligation to give updated information and obtain renewed consent, we will follow those requirements. This general Notice alone is not a substitute for any transaction-specific consent procedure required by law.
5. PAPER COPIES AND NON-ELECTRONIC OPTIONS
If applicable law gives a recipient a right or option to receive a record on paper or in another nonelectronic form, we will provide information about that right or option before obtaining any consent for which advance disclosure is legally required. A request concerning a paper copy of a GOT2DEV record may be sent to the contact addresses in Section 10, identifying the record requested without sending passwords or unnecessary sensitive data. Availability of paper copies and any applicable charge will be disclosed before any charge is imposed and as required by law. We will honor requests for paper records where legally required; this Notice does not promise that every Service record is available on paper or establish an undisclosed paper-copy fee. A Business is separately responsible for any paper-copy or delivery duties that it owes to its own customers.
6. KEEPING CONTACT INFORMATION CURRENT
Account users and Businesses should keep authorized email addresses and other contact details current and monitor their relevant inboxes and Service notifications. Requests to correct contact information may be made through supported account controls or the contact channels in Section 10, subject to identity and account-authorization checks. We may rely on properly maintained contact information to the extent permitted by applicable law, but legal delivery requirements are not automatically satisfied by sending a message to an outdated, invalid, or inaccessible address. Users should promptly report suspected account compromise or inability to access important communications.
7. WITHDRAWAL OR MODIFICATION OF ELECTRONIC CONSENT
Where applicable law provides a right to withdraw consent to receive specified records electronically, the recipient may request withdrawal by contacting support@got2dev.com or legal@got2dev.com and identifying the relevant account, transaction, or record category without including sensitive credentials. We will handle the request in accordance with the applicable law, any required authentication, and any available supported account process. Where law requires withdrawal to become effective within a reasonable time after receipt, we will follow that requirement. Withdrawal does not retroactively invalidate electronic records or signatures that were lawfully provided or completed before the withdrawal became effective. Withdrawal may affect use of particular electronic-only features or a relationship when lawfully disclosed in advance, but it does not cancel a paid subscription or override separately applicable cancellation and payment requirements by itself. Any fees, conditions, or consequences that applicable law requires us to disclose before consent must be disclosed before that consent is obtained; we will not impose charges or consequences prohibited by law.
8. ELECTRONIC SIGNATURES, ACCEPTANCE EVIDENCE, AND CUSTOMER PORTAL
Where permitted by applicable law, an affirmative electronic action, such as selecting an acceptance checkbox and submitting its associated form, may constitute an electronic signature or acceptance when the record and circumstances demonstrate intent and the other legal requirements are satisfied. Supported workflows may retain evidence such as the particular notice or agreement version, acceptance time, user and business context, electronic signature, and relevant request metadata to the extent necessary and lawful. An electronic action does not automatically satisfy every signature, record-retention, authentication, or consumer-consent requirement for every transaction.
When a Business uses the Customer Portal to request a customer's approval or signature on an estimate or other supported document, the Business is responsible for the underlying customer relationship, document accuracy, and its own notice and consent obligations. Any customer-facing electronic consent and signature must be evaluated in the context of that particular transaction and applicable law; acceptance of this general GOT2DEV Notice is not a substitute for that transaction's required consent. Our handling of personal information and acceptance evidence remains subject to the Privacy Policy and applicable law.
9. CHANGES TO THIS NOTICE
Published versions identify their version and effective date and remain preserved in published legal history. We may revise this Notice to reflect product features, communication methods, providers, or applicable law. Material changes will be communicated, and fresh consent or reacceptance obtained, where required by applicable law or a binding agreement. Where a change in access or retention technology triggers a legally required updated hardware/software disclosure and renewed consent, the applicable process must occur before the affected legally required electronic delivery. No published version is silently rewritten by later configuration changes.
